These Terms and Conditions govern your use of our website and the purchase of products we offer. By accessing the website or purchasing products, you agree to these Terms and our Privacy Policy.

This website is operated by Elliot Australia Pty Ltd (Company), an Australian supplier of automated external defibrillators (AEDs), including the Elliot AED manufactured by Hearthero Inc., accessories, and related consumables.

You must be at least 18 years old to make purchases.

2. Product Information Safety

We aim to provide accurate product descriptions, images, and specifications. Product availability may change without notice.

2.1 Medical Device Use

The Elliot AED is a lifecritical medical device that must be used only in accordance with its Instructions for Use (IFU). Improper or untrained use may result in serious harm.

2.2 Critical Safety Information

The Elliot AED is intended for use in sudden cardiac arrest emergencies only. This website and its content must not be treated as:

  • A substitute for medical training or certification
  • A substitute for emergency medical services (always call 000 first)
  • Professional medical advice or diagnosis
  • A replacement for reading the device’s IFU and warnings

Device Performance Limitations: No AED can guarantee successful defibrillation, survival, rhythm analysis accuracy in all circumstances, or correct functioning in all environmental conditions.

2.3 Training Requirements

Users must ensure they have received appropriate AED and CPR training from recognised training providers.

2.4 No Medical Advice

Website content is general information only and is not a substitute for medical advice or emergency services.

2.5 Emergency Services Requirement

Always contact emergency services immediately when sudden cardiac arrest is suspected before using the device and follow dispatcher instructions.

3. Data Regulatory Reporting Requirements

3.1 Event Data Collection

During use, the Elliot AED may collect event data (e.g., ECG recordings, shock events, timestamps, device performance information). Data may be shared with emergency responders, regulatory authorities, or as required by law.

3.2 Adverse Event Reporting

You must immediately report any of the following to Elliot Australia Pty Ltd and the Therapeutic Goods Administration (TGA):

  • Device malfunction, failure, or unexpected behaviour
  • Serious injury or death associated with device use or malfunction
  • Inaccurate rhythm analysis or inappropriate shock delivery
  • Software/hardware defects affecting safety
  • Any event that may pose a risk to users or patients

Required information includes: device serial number, description of event, timing, conditions of use, outcome, and your contact details.

Devices involved in an adverse event must be preserved for investigation. Do not attempt repair or modification.

4. User Responsibilities

You agree to:

  • Use AEDs only as instructed
  • Maintain devices according to manufacturer specifications
  • Replace consumables (pads, batteries) before expiry
  • Install required software/firmware updates
  • Not modify, reverse engineer, tamper with or repair the device

Failure to meet these requirements may void warranties or compromise device performance.

5. Pricing & Payment

All prices are in Australian dollars (AUD) and include GST unless noted. Prices may change without notice.

Payment must be made in full at checkout. Orders are not confirmed until payment is successfully processed.

6. Shipping & Delivery

We ship Australiawide. Estimated delivery timeframes: TBD

  • Metro: 2–5 business days
  • Regional: 3–7 business days
  • Remote: 5–10 business days

Timeframes are estimates only. Risk transfers to you once the order is delivered to your nominated address. A street address (not a PO box) is required.

Incorrect addresses or failed delivery attempts may incur additional charges.

7. Returns, Refunds & Warranty

7.1 Returns

We want you to feel confident in your purchase.
If you believe your product is faulty or has arrived damaged, please contact us as soon as possible so we can assist.
Returns may be accepted in accordance with Australian Consumer Law.

7.2 Change of Mind

Due to the nature of medical and safety equipment, change-of-mind returns may not be accepted once the product has been opened or used. Please contact our team to discuss your situation.

7.3 Faulty or Damaged Goods

If your Elliot AED arrives damaged or develops a fault:

  • Contact us within a reasonable timeframe
  • Provide order details and a description of the issue
  • Our team will guide you through the next steps
We are committed to resolving issues quickly.

7.4 Manufacturer Warranty

Most AEDs and accessories include a manufacturer warranty covering defects in materials or workmanship. Remedies may include repair, replacement, or refund.

7.5 A Warranty Exclusions

Manufacturer warranties generally do not cover:

  • Damage caused by misuse, neglect, or improper storage
  • Use of expired, damaged, or counterfeit pads or batteries
  • Normal wear and tear
  • Damage caused by unauthorised repairs, modifications, or tampering
  • Use of the device in nonapproved jurisdictions
  • Failure to install mandatory software/firmware updates

These exclusions align with typical AED warranty scopes and help clarify user responsibilities.

7.5 B Consumables

Consumables such as electrode pads and batteries:

  • Are not covered under warranty unless faulty on arrival
  • Must be replaced before their expiry date
  • Can degrade if not stored according to manufacturer guidelines

This ensures clarity for customers purchasing parts with known shelf lives.

7.6 Website Warranty Disclaimer

To the fullest extent permitted by law:

  • The website and its content are provided “as is” and “as available”, without warranties of any kind
  • We do not guarantee the website will be uninterrupted, errorfree, or free from viruses or harmful code
  • You are responsible for ensuring your own cybersecurity protections

This does not affect any express warranties provided with the Elliot AED device itself.

8. Australian Consumer Law

Nothing in these Terms excludes or limits your rights under the ACL. Where permitted, our liability is limited to repair, replacement, or refund of the product.

9. Limitation of Liability

To the extent permitted by law, the Company is not liable for:

  • Indirect or consequential loss
  • Improper use or unauthorised modifications of products
  • Issues arising from failure to maintain or update devices
  • Device malfunction due to misuse or failure to follow IFU
  • Outcomes related to emergency response or medical decisions

Emergency services must always be contacted immediately in suspected sudden cardiac arrest situations.

10. Intellectual Property

All website content—including images, text, and logos—is owned by or licensed to the Company. You may not reproduce or distribute any content without written permission.

11. Privacy

Personal information is handled in accordance with our Privacy Policy.

12. ThirdParty Links

We may link to external websites. We are not responsible for their content or practices.

13. Changes to Terms

We may update these Terms at any time. Continued use of the website constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the exclusive jurisdiction of NSW courts.
